New Mexico Table of Authorities: Rule 12-318
On this page3 sections
New Mexico appellate briefs require a table of authorities grouped by authority type, with New Mexico decisions separated from other jurisdictions. Rule 12-318(A)(2) NMRA also requires alphabetical case lists and page references. Answer briefs conform under (B), and replies expressly follow the table paragraph under (C). This is a statewide appellate briefing rule, not a requirement to add the same front matter to every trial-court paper.
Build and review your New Mexico table of authorities. Use the standard format: there is no New Mexico-specific preset. Confirm the actual court and table settings before export; detected courts and samples can change the initial selection.
Separate New Mexico cases from other decisions
“a table of authorities, arranged in separate headings for each type of authority cited, listing cases alphabetically (New Mexico decisions separately from decisions from other jurisdictions), statutes, and other authorities, with page references” — Rule 12-318(A)(2) NMRA.
The answer rule’s exception concerns the summary of proceedings, not the table. The reply rule expressly retains the table even though a reply only answers arguments or authorities presented in the answer. Build each table from that particular brief, rather than recycling the opening brief’s page list. Cross-appeal documents comply with this rule under (I). A supplemental-authorities notice under (D)(2) is a different filing; the ordinary-brief table requirement does not automatically attach to every appellate notice or trial memorandum.
| Filing or issue | Requirement and review action |
|---|---|
| New Mexico decisions | Separate case group; alphabetize and retain complete identifying citations. |
| Other jurisdictions’ decisions | Separate from New Mexico decisions; alphabetize cases within the group. |
| Statutes and other authority types | Use separate headings for each type actually cited and add brief-page references. |
| Answer brief | Same table requirement as brief in chief; summary exception does not remove it. |
| Reply brief | Table required by explicit incorporation of (A)(2). |
| Length calculation | Authorities table is outside the defined body under (F)(1); independently assess the applicable length rule. |
Paragraph pinpoints are not table page references
New Mexico’s official citation form includes the release year, court initials and sequential number. Rule 23-112(B) requires that form for appellate opinions, with a paragraph symbol and number when a pinpoint is used. Its appendix explains the mandatory New Mexico Reports parallel citation through Volume 150, the final volume of that series; Pacific Reporter citation is discretionary. The rule contains a specific citation exception for self-represented litigants. Review the rule rather than treating every permissible self-represented citation as the normal counsel form.
The appendix’s sourced example is Bianco v. Horror One Prods., 2009-NMSC-006, ¶ 10, 145 N.M. 551. Here “¶ 10” identifies a paragraph in the opinion. If that citation occurs on pages 7 and 12 of your brief, the table’s page column would be “7, 12.” Those brief pages are hypothetical, not an example from a filed case. Do not replace the table’s brief-page references with opinion paragraph numbers, and do not interpret “006” as a volume or page. Rule 23-112 supplies local citation rules and otherwise directs use of the current Bluebook.
From a brief PDF to an editable Word table
- Export the brief to PDF. Retain matching Word for insertion. Use printed brief pages, not viewer sheet numbers or opinion paragraphs.
- Open the TOA generator. Confirm standard-format settings and separate New Mexico and other-jurisdiction case groups.
- Review every entry and page against the PDF. Check complete citations and short forms, merge genuine duplicates and add omissions. Preserve official citation identifiers and jurisdiction grouping. The app does not restyle citations.
- Export editable Word. PDF-only downloads a .docx table. Matching Word plus a text-layer PDF can insert ordinary table text. DOCX-only instead creates TA and TOA fields for Word for Windows to build and update.
- Re-export and recheck. Insertion and later edits can move references. Inspect the final PDF and regenerate if needed. Check all other filing requirements separately; the tool does not format the whole brief or add PDF bookmarks.
The approved PDFs are amendment-format documents: deleted text is struck through and additions are underlined. The quoted table provision is unchanged in the 2024 rule amendment. The source date is not the date this guide was checked. Consult the operative NMRA compilation and any later rule order before filing; access to the court’s general rules portal failed during this review, while both linked official rule PDFs were accessible.
Frequently asked
Must New Mexico and federal cases be separated?
Yes. Rule 12-318(A)(2) requires New Mexico decisions separately from decisions of other jurisdictions, which includes federal and other-state decisions. Cases must be listed alphabetically.
Does a reply brief need its own table?
Yes. Paragraph (C) expressly incorporates the table requirement in (A)(2). Its references should point to the reply’s pages, not the opening brief.
Can I omit the table from an answer brief?
Paragraph (B) requires conformity to the brief-in-chief requirements. Its exception for an unnecessary summary of proceedings does not waive the authorities table.
Should the table’s page column list opinion paragraphs?
No. Opinion paragraphs provide pinpoints within the cited decision. The authority table locates citations in your brief using brief-page references.
Does the citation rule apply in trial court?
Rule 23-112 governs citations in state-court pleadings and papers, but that does not carry Rule 12-318’s appellate table requirement into every trial document. The citation rule and table requirement have different scopes.
