# Vermont Table of Authorities: Appellate Briefs

> Vermont appellate tables under Rule 28: cases, statutes, other authorities, principal-brief scope and PDF-to-Word review, with source limits.

*Updated: 2026-10-14*

**Vermont Rule of Appellate Procedure 28(a)(2), as reproduced in the secondary source read here, requires an appellant’s contents table and table of cases, statutes and other authorities.** Cases are alphabetical and entries refer to the brief pages where they are cited. Rule 28(b) makes the appellee’s principal brief conform, with exceptions for the case statement and standard of review—not for the tables.

[Create a Vermont table of authorities from your brief’s PDF](/table-of-authorities-generator?court=generic#tool), review it and export editable Word output. Vermont uses **standard format**, not a Vermont-specific preset. The complete secondary rule was read October 14, 2026; current official text could not be accessed and remains unverified.

> **Read this source limit before filing.** Vermont Judiciary pages and official amendment PDFs returned HTTP 403. The LexisNexis public court-rules index opened, but selecting Rule 28 encountered a CAPTCHA; the rule text was not read there. This guide uses the complete Court Rules Network reproduction and labels its quotation accordingly. Its amendment history lists an April 1, 2024 amendment effective July 1, 2024. That date is distinct from our October 14, 2026 check date. Confirm the current official rule and court directions before relying on this guide.

**What the reproduced appellate rule requires**

- Rule 28(a)(2): contents plus a table of alphabetically arranged cases, statutes and other authorities, with brief-page references.
- The rule’s phrase ‘table of cases’ does not mean statutes and other authorities can be omitted.
- The issue statement comes first under Rule 28(a); tables follow it rather than preceding every substantive component.
- Rule 28(b) applies the requirements to appellee principal briefs, subject to specified exceptions.
- Rule 28(c) authorizes a reply but does not separately repeat a table requirement; check applicable directions for the document being filed.
- This is a Vermont Supreme Court appellate guide, not a verified mandate for Superior Court motion practice.

## The table of cases includes more than cases

> “a table of contents and a table of cases (alphabetically arranged), statutes, and other authorities—with references to the pages of the brief where they are cited” — V.R.A.P. 28(a)(2), secondary reproduction; current official text not verified

Vermont’s terminology can mislead a filer looking for a provision headed ‘table of authorities.’ The reproduced clause calls the list a table of cases, then includes statutes and other authorities. A descriptive heading such as ‘Table of Cases, Statutes, and Other Authorities’ communicates that coverage. It is a practical heading choice, not a claim that the exact label is mandated.

The order is also worth checking. Rule 28(a)(1) starts with a statement of issues, with pages where each discussion begins. Paragraph (a)(2) then provides the tables. Issue-discussion pages belong in the issue statement, while every authority’s citation locations belong in the authorities table. A contents table lists sections, not the cases used in them. These navigation aids solve separate problems.

**Vermont principal-brief review matrix (secondary text)**

| Document or list | Provision | Review consequence |
| --- | --- | --- |
| Appellant principal brief | 28(a)(1)–(2) | Issue statement first, then tables; include cited cases, statutes and other authorities. |
| Appellee principal brief | 28(b) | Conforms to the requirements; satisfaction with the appellant’s case statement does not remove the tables. |
| Cross-appeal principal brief | 28(d)(2) | Addresses the cross-appeal and response; reproduced rule incorporates (a)(1)–(5). |
| Ordinary reply | 28(c) | Reply authorized; provision does not expressly repeat the table clause. Verify other governing directions. |
| Record citation | 28(e) | Locate the record material using the prescribed record-reference system; do not substitute those locations for brief pages in the table. |

## Keep brief pages separate from record references

The reproduced Rule 28(e) distinguishes an Appeal Volume citation, a Printed Case citation and transcript or audio references. Those references support factual and procedural assertions. The table’s page column instead tells the reader where an authority is cited **inside your brief**. Do not copy an AV or PC page into that column merely because it appears near a case citation.

This guide does not verify the current rules on producing a printed case; official amendment materials were inaccessible. Keep that separate document question on your filing checklist. For the authorities table, check footnotes, standards of review and other sections as well as the main argument. Reconcile full citations and short forms by decision, preserving distinct opinions involving similar parties. The table clause does not answer a passim policy. Listing actual brief pages is useful without asserting unverified permission or prohibition.

## A PDF-to-Word workflow with a final pagination check

- **Export the correct document.** Save the principal or reply brief to PDF with the intended printed page numbers. Retain the matching Word file if you want insertion into the editable brief.
- **Choose standard format.** Add the PDF in the [TOA generator](/table-of-authorities-generator?court=generic#tool). Confirm the court and settings because detection or a sample may override the initial selection.
- **Review citations and coverage.** Check every authority, merge only genuine duplicates and add missing entries. Include statutes and other authorities despite the Vermont ‘table of cases’ wording. Verify every listed brief page against the PDF.
- **Export editable Word output.** PDF-only downloads a table to insert manually. Matching Word plus text-layer PDF can insert ordinary table text into your Word brief. Neither option restyles citations or formats the whole document.
- **Re-export after assembly.** Tables and later edits can change pagination. Review the final PDF and regenerate references that moved. Check current official rules, full-brief formatting and filing directions separately; the app does not add e-filing bookmarks.

DOCX-only processing is a separate route: it creates TA fields and a TOA field for Word for Windows to build and update. Use the PDF workflow for ordinary editable table text without relying on Windows field updates.

> **Build the navigation table, retain the rule review:** Brief Authority is free, with no account required. The document stays on your device for processing and is not uploaded. Start with standard format, then verify the current Vermont requirements and every citation and final page reference.

## Frequently asked

**Does ‘table of cases’ exclude statutes?**

No in the complete Rule 28 reproduction read here. Paragraph (a)(2) expressly includes statutes and other authorities as well as alphabetically arranged cases.

**Does the appellee need its own table?**

The reproduced Rule 28(b) makes the appellee’s principal brief conform. Its exceptions concern the case statement and standard of review, not the tables. Generate from the appellee’s own text and pagination.

**Do the tables go before the issue statement?**

Not in the reproduced Rule 28(a) sequence: (1) is the issue statement and (2) is the tables. Confirm current official wording before final assembly.

**Can I use record pages as authority locations?**

No. Record references identify evidence or proceedings. An authorities table identifies the brief pages where cited legal authorities appear. A Printed Case page is not automatically a brief page.

**Was the current official rule read?**

No. Official judiciary pages and amendment PDFs returned 403, and the public publisher’s rule selection encountered a CAPTCHA. The complete secondary text was read October 14, 2026; current official wording remains unverified.
